Do\u011fan t\u00fcm maddi zarar ve sorumluluk ALICI'ya aittir.<\/p>\n<h3 id=\"wc-tr-sec-4\">MADDE 4 - CAYMA HAKKI \u0130ST\u0130SNASI (GIDA \u00dcR\u00dcNLER\u0130NDE CAYMA HAKKI YOKTUR)<\/h3>\n<p>4.1. \u0130\u015fbu s\u00f6zle\u015fme konusu \u00fcr\u00fcnler; g\u00fcnl\u00fck taze \u00fcretim yap\u0131lan, \u00e7abuk bozulabilen, tazeli\u011fini ve son t\u00fcketim \u00f6mr\u00fcn\u00fc h\u0131zla yitiren g\u0131da maddeleri niteli\u011findedir. Bu do\u011frultuda <strong>6502 say\u0131l\u0131 T\u00fcketicinin Korunmas\u0131 Hakk\u0131nda Kanun'un 48. maddesinin 4. f\u0131kras\u0131<\/strong> ve <strong>Mesafeli S\u00f6zle\u015fmeler Y\u00f6netmeli\u011fi'nin 15. maddesinin 1. f\u0131kras\u0131n\u0131n (\u00e7) bendi<\/strong> (<em>\"\u00c7abuk bozulabilen veya son kullanma tarihi ge\u00e7ebilecek mallar\u0131n teslimine ili\u015fkin s\u00f6zle\u015fmeler\"<\/em>) gere\u011fince <strong>ALICI'NIN KANUNEN CAYMA HAKKI BULUNMAMAKTADIR<\/strong>.<\/p>\n<p>4.2. <strong>Subjektif \/ Be\u011feniye Dayal\u0131 \u0130ade Yasa\u011f\u0131:<\/strong> ALICI'n\u0131n ki\u015fisel damak tad\u0131na, zevkine veya subjektif de\u011ferlendirmesine dayal\u0131 olarak \u00f6ne s\u00fcrece\u011fi <em>\"tad\u0131n\u0131 be\u011fenmedim\", \"ho\u015fuma gitmedi\", \"lezzetini uygun bulmad\u0131m\", \"beklentimi kar\u015f\u0131lamad\u0131\"<\/em> ve benzeri nedenlerle \u00fcr\u00fcnlerin iadesi, iptali veya sipari\u015f bedelinin geri \u00f6denmesi hukuken ve s\u00f6zle\u015fmesel olarak kesinlikle m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<h3 id=\"wc-tr-sec-5\">MADDE 5 - KARGO HASARLARI VE YEN\u0130 \u00dcR\u00dcN G\u00d6NDER\u0130M PROSED\u00dcR\u00dc<\/h3>\n<p>5.1. Ta\u015f\u0131y\u0131c\u0131 kargo firmas\u0131ndan kaynaklanan ezilme, ambalaj y\u0131rt\u0131lmas\u0131, patlama veya kargo lojisti\u011findeki a\u015f\u0131r\u0131 gecikmeler neticesinde \u00fcr\u00fcn\u00fcn hasara u\u011framas\u0131 ve t\u00fcketilemez hale gelmesi durumunda <strong>\u00fccret\/para iadesi yap\u0131lmaz; SATICI taraf\u0131ndan ALICI ad\u0131na ivedilikle YEN\u0130 \u00dcR\u00dcN G\u00d6NDER\u0130M\u0130 (telafi sevkiyat\u0131) sa\u011flan\u0131r<\/strong>.<\/p>\n<p>5.2. <strong>Hasar Tespit Tutana\u011f\u0131 Zorunlulu\u011fu:<\/strong> Yeni \u00fcr\u00fcn g\u00f6nderiminin yap\u0131labilmesi i\u00e7in; kargo teslimi an\u0131nda kargo personeli huzurunda paketin kontrol edilerek \u0131slak imzal\u0131 <strong>\"Kargo Hasar Tespit Tutana\u011f\u0131\"<\/strong> d\u00fczenlettirilmesi kanunen ve s\u00f6zle\u015fmesel olarak ZORUNLUDUR. Tutana\u011f\u0131n d\u00fczenlettirilmesi ve tutanak g\u00f6rselinin ayn\u0131 g\u00fcn i\u00e7erisinde SATICI'ya ula\u015ft\u0131r\u0131lmas\u0131 m\u00fcnhas\u0131ran <strong>ALICI'n\u0131n sorumlulu\u011fundad\u0131r<\/strong>.
