ALICI, kargo firmas\u0131 se\u00e7imi hususunda m\u00fcnhas\u0131r bir tercih hakk\u0131 bulunmad\u0131\u011f\u0131n\u0131 ve sistemin atad\u0131\u011f\u0131 ta\u015f\u0131y\u0131c\u0131y\u0131 pe\u015finen kabul etti\u011fini beyan eder.<\/p>\n<p>4.2. <strong>Kargo Kontrol Y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc:<\/strong> ALICI, teslimat an\u0131nda paketin d\u0131\u015f fiziki durumunu kargo g\u00f6revlisinin huzurunda muayene etmekle m\u00fckelleftir. Pakette y\u0131rt\u0131lma, ezilme, \u0131slanma, patlama veya benzeri deformasyon tespit edilirse kargo teslim al\u0131nmamal\u0131, kargo personeline derhal \u0131slak imzal\u0131 resmi <strong>\"Kargo Hasar Tespit Tutana\u011f\u0131\"<\/strong> tanzim ettirilmelidir.<\/p>\n<p>4.3. <strong>Teslim Al\u0131nmayan \/ Kabul Edilmeyen Kargolar:<\/strong> ALICI'n\u0131n bildirdi\u011fi teslimat adresine ula\u015ft\u0131r\u0131lan ancak ALICI taraf\u0131ndan kabul edilmeyen, teslim al\u0131nmaktan imtina edilen veya adreste bulunulmamas\u0131 sebebiyle \u015fubeden teslim s\u00fcresinde al\u0131nmay\u0131p iade d\u00f6nen g\u0131da kargolar\u0131nda; \u00fcr\u00fcnler \u00e7abuk bozulabilen taze g\u0131da niteli\u011finde oldu\u011fundan ve tazeli\u011fini yitirece\u011finden \u00f6t\u00fcr\u00fc <strong>H\u0130\u00c7B\u0130R SURETLE \u00dcCRET \u0130ADES\u0130 YAPILMAZ<\/strong>. Do\u011fan t\u00fcm maddi ziyan ve sorumluluk m\u00fcnhas\u0131ran ALICI'ya aittir.<\/p>\n<h3 id=\"wc-tr-sec-5\">MADDE 5 - CAYMA HAKKI \u0130ST\u0130SNASI (YASAL H\u00dcK\u00dcM)<\/h3>\n<p>5.1. S\u00f6zle\u015fmeye konu \u00fcr\u00fcnler; g\u00fcnl\u00fck taze \u00fcretim yap\u0131lan, \u00e7abuk bozulabilen, tazeli\u011fini ve son t\u00fcketim \u00f6mr\u00fcn\u00fc h\u0131zla yitiren g\u0131da maddeleri niteli\u011findedir. Bu do\u011frultuda <strong>6502 say\u0131l\u0131 Kanun'un 48\/4. maddesi<\/strong> ile <strong>Mesafeli S\u00f6zle\u015fmeler Y\u00f6netmeli\u011fi'nin 15. maddesinin 1. f\u0131kras\u0131n\u0131n (\u00e7) bendi<\/strong> (<em>\"\u00c7abuk bozulabilen veya son kullanma tarihi ge\u00e7ebilecek mallar\u0131n teslimine ili\u015fkin s\u00f6zle\u015fmeler\"<\/em>) ve hijyen kurallar\u0131 uyar\u0131nca <strong>ALICI'NIN CAYMA HAKKI BULUNMAMAKTADIR<\/strong>.<\/p>\n<p>5.2. <strong>Be\u011feniye Dayal\u0131 \u0130ade Yasa\u011f\u0131:<\/strong> ALICI'n\u0131n ki\u015fisel damak tad\u0131na, zevkine veya subjektif alg\u0131s\u0131na dayal\u0131 olarak \u00f6ne s\u00fcrece\u011fi <em>\"tad\u0131n\u0131 be\u011fenmedim\", \"ho\u015fuma gitmedi\", \"beklentimi kar\u015f\u0131lamad\u0131\", \"damak zevkime uymad\u0131\"<\/em> ve benzeri nedenlerle \u00fcr\u00fcn iadesi, sipari\u015f iptali veya para iadesi talep edilmesi hukuken ve s\u00f6zle\u015fmesel olarak kesinlikle m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<h3 id=\"wc-tr-sec-6\">MADDE 6 - TA\u015eIMA HASARLARI VE YEN\u0130 \u00dcR\u00dcN G\u00d6NDER\u0130M\u0130 ESASLARI<\/h3>\n<p>6.1. Ta\u015f\u0131y\u0131c\u0131 kargo firmas\u0131ndan kaynaklanan ezilme, y\u0131rt\u0131k, patlak veya kabul edilemez a\u015f\u0131r\u0131 gecikmeler neticesinde \u00fcr\u00fcn\u00fcn hasarl\u0131 ve t\u00fcketilemez hale gelmesi durumunda <strong>\u00fccret\/para iadesi yap\u0131lmaz; SATICI taraf\u0131ndan ALICI'ya YEN\u0130 \u00dcR\u00dcN G\u00d6NDER\u0130M\u0130 (telafi sevkiyat\u0131) ger\u00e7ekle\u015ftirilir<\/strong>.<\/p>\n<p>6.2. <strong>Hasar Tespit Tutana\u011f\u0131 Zorunlulu\u011fu:<\/strong> Yeni \u00fcr\u00fcn g\u00f6nderiminin yap\u0131labilmesi i\u00e7in; kargo teslimi s\u0131ras\u0131nda kargo personeli huzurunda tutulmu\u015f resmi <strong>\"Kargo Hasar Tespit Tutana\u011f\u0131\"<\/strong> bulunmas\u0131 \u015fartt\u0131r. Bu tutana\u011f\u0131n kargo personeline eksiksiz d\u00fczenlettirilmesi ve tutanak n\u00fcshas\u0131n\u0131n ayn\u0131 g\u00fcn i\u00e7erisinde SATICI'ya iletilmesi tamamen <strong>ALICI'n\u0131n sorumlulu\u011fundad\u0131r<\/strong>. Hasar tutana\u011f\u0131 bulunmayan veya teslimden sonra bildirilen hasar iddialar\u0131nda yeni \u00fcr\u00fcn g\u00f6nderimi yap\u0131lmaz.<\/p>\n<h3 id=\"wc-tr-sec-7\">MADDE 7 - UYU\u015eMAZLIKLARIN \u00c7\u00d6Z\u00dcM\u00dc VE Y\u00dcR\u00dcRL\u00dcK<\/h3>\n<p>\u0130\u015fbu S\u00f6zle\u015fme'nin uygulanmas\u0131ndan do\u011fabilecek uyu\u015fmazl\u0131klarda, T.C. Ticaret Bakanl\u0131\u011f\u0131'nca her y\u0131l ilan edilen parasal s\u0131n\u0131rlar dahilinde ALICI'n\u0131n veya SATICI'n\u0131n yerle\u015fim yerindeki T\u00fcketici Hakem Heyetleri ile T\u00fcketici Mahkemeleri yetkilidir.
